Trustee Companies Regulations 2026

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Trustee Companies Act 1953 .

1.   Short title

These regulations may be cited as the Trustee Companies Regulations 2026 .

2.   Commencement

These regulations take effect on 27 September 2026.

3.   Interpretation

In these regulations –
Act means the Trustee Companies Act 1953 .

4.   Prescribed amounts under section 10A of Act

(1)  For the purposes of section 10A(1)(c) of the Act, the prescribed amount is $105 000.
(2)  For the purposes of section 10A(6)(a) of the Act, the prescribed amount is $112 000.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe, for the purposes of the Trustee Companies Act 1953 , certain amounts relating to an election to administer small estates under that Act; and
(b) are made consequentially on the repeal of the Trustee Companies Regulations 2016 under section 11 of the Subordinate Legislation Act 1992 .
