Emergency Management Amendment Regulations 2021

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Emergency Management Act 2006 .

1.   Short title

These regulations may be cited as the Emergency Management Amendment Regulations 2021 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Emergency Management Regulations 2020 are referred to as the Principal Regulations.

4.    Regulation 4 amended (Infringement notice offences)

Regulation 4 of the Principal Regulations is amended as follows:
(a) by omitting from paragraph (a) " section 60(c) of the Act" and substituting "section 60(c) or (d) of the Act";
(b) by omitting from paragraph (b)(i) "4.5 penalty units" and substituting "9 penalty units".

These regulations are administered in the Department of Police, Fire and Emergency Management.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Emergency Management Regulations 2020 by –
(a) enabling an infringement notice to be issued in respect of the offence of providing false or misleading information to an emergency management worker; and
(b) increasing the penalty that may be payable by an individual in respect of an infringement notice under the Emergency Management Act 2006 .
