First Home Owner Grant Regulations 2021

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the First Home Owner Grant Act 2000 .

1.   Short title

These regulations may be cited as the First Home Owner Grant Regulations 2021 .

2.   Commencement

These regulations take effect on 16 June 2021.

3.   Interpretation

In these regulations –

Act means the First Home Owner Grant Act 2000 ;

Director of Housing means the Director of Housing appointed under the Homes Act 1935 .

4.   Exclusion from application of section 15 of Act

If the Commissioner recognises a non-conforming interest as a relevant interest in land under section 5(4) of the Act, the holder of a relevant interest in the land (other than the holder of the non-conforming interest) is excluded from the application of section 15 of the Act.

5.   Exclusion of Director of Housing from application of section 15 of Act

The Director of Housing is excluded from the application of section 15 of the Act.

6.   Protection of confidential information

For section 40(4)(d) of the Act, protected information may be disclosed to a State Service officer or State Service employee employed in the Department if the information is not likely to identify a particular applicant for a first home owner grant.

EXPLANATORY NOTE

(This note is not part of the regulation)

(a) specify that certain persons are not required to be applicants for the purposes of the First Home Owner Grant Act 2000 ; and

(b) authorise certain information to be disclosed to specified persons in certain circumstances; and

(c) are made consequentially on the repeal of the First Home Owner Grant Regulations 2010 under section 11 of the Subordinate Legislation Act 1992 .
