Public Health (Smoking Product Licence) Regulations 2019

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Public Health Act 1997 .

1.   Short title

These regulations may be cited as the Public Health (Smoking Product Licence) Regulations 2019 .

2.   Commencement

These regulations take effect on 25 November 2019.

3.   Interpretation

In these regulations –
Act means the Public Health Act 1997 .

4.   Fees

(1)  For section 74B of the Act, the prescribed fee for an application for a smoking product licence where the application is for a licence to sell both tobacco products and personal vaporiser products, or only tobacco products, is 717 fee units for each premises specified in the application.
(2)  For section 74B of the Act, the prescribed fee for an application for a smoking product licence, where the application is for a licence to sell personal vaporiser products and the applicant does not hold a smoking product licence to sell tobacco products, is 360 fee units for each premises specified in the application.
(3)  For section 74B of the Act, the prescribed fee for an application for a smoking product licence, where the application is for a licence to sell personal vaporiser products and the applicant holds a smoking product licence to sell tobacco products, is no fee units for each premises specified in the application.
(4)  For section 74F of the Act, the prescribed fee for an application for the renewal of a smoking product licence to sell both tobacco products and personal vaporiser products, or only tobacco products, is 717 fee units for each premises specified in the application.
(5)  For section 74F of the Act, the prescribed fee for an application for the renewal of a smoking product licence to sell personal vaporiser products, where the applicant does not also hold a smoking product licence to sell tobacco products, is 360 fee units for each premises specified in the application.
(6)  For section 74F of the Act, the prescribed fee for an application for the renewal of a smoking product licence to sell personal vaporiser products, where the applicant also holds a smoking product licence to sell tobacco products, is no fee units for each premises specified in the application.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe certain fees payable for each premises specified in –
(i) an application for certain smoking product licences; and
(ii) an application for the renewal of certain smoking product licences; and
(b) are made consequentially on the repeal of the Public Health (Smoking Product Licence) Regulations 2009 under section 11 of the Subordinate Legislation Act 1992 .
