Economic Regulator (Metro Bus Fares) Order 2014

I make the following order under section 36 of the Economic Regulator Act 2009 .

1.   Short title

This order may be cited as the Economic Regulator (Metro Bus Fares) Order 2014 .

2.   Commencement

This order takes effect on the sixty-first day after the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this order –

Agreement means –

(a) the agreement, as amended from time to time, in respect of the provision of scheduled route services –

(i) made on 24 December 2008; and

(ii) made between the Transport Commission and Metro; and

(iii) signed on behalf of the Transport Commission by the Commissioner for Transport and on behalf of Metro by the Chairperson of the Metro Board; or

(b) an agreement, as amended from time to time, made in respect of scheduled route services, between the Transport Commission and Metro, that replaces or supersedes the agreement referred to in paragraph (a) ;

Chairperson of the Metro Board means the chairperson of the board of directors of the Company formed under the Metro Tasmania Act 1997 ;

Commissioner for Transport means the Commissioner for Transport as defined in the Transport Act 1981 ;

first year means the period of 12 months commencing on the day on which this order takes effect;

full adult fare means the fare to be charged to a full-fare-paying adult passenger for a single-trip ticket;

Metro means Metro Tasmania Pty. Ltd.;

Metro Greencard means an electronic card issued by Metro that stores credit for travel on scheduled route services;

scheduled route services means the regular passenger transport services specified in the Agreement as comprising the Metro Service Activity that Metro is contracted to deliver;

second year means the period of 12 months commencing on the first anniversary of the day on which this order takes effect;

Transport Commission means the Transport Commission as defined in the Transport Act 1981 .

(2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were regulations.

4.   Scope of order

This order specifies the maximum full adult fares that Metro may charge for travel on scheduled route services.

5.   Maximum full adult fare for single trip

(1)  A full adult fare charged by Metro at any time during the first year must not exceed, for a single trip of the length described in column 1 of Schedule 1 , the amount specified in column 2 of that Schedule.

(2)  A full adult fare charged by Metro at any time during the second year must not exceed, for a single trip of the length described in column 1 of Schedule 1 , the amount specified in column 3 of that Schedule.

6.   Metro Greencard discount

Despite clause 5 , if a full adult fare-paying passenger presents a Metro Greencard as the means of payment for travel on scheduled route services, the amount debited from the Metro Greencard must not exceed, for a single trip, 80 percent of the amount of the full adult fare for that trip as designated in clause 5 .

7.   Expiry

This order ceases to have effect at the end of the period of 2 years commencing on the day on which this order takes effect.

8.   Legislation revoked

The legislation specified in Schedule 2 is revoked.

EXPLANATORY NOTE

(This note is not part of the order)

(a) specifies the maximum full adult fares that Metro Tasmania Pty. Ltd. may charge on scheduled route services during the period of 2 years following the day on which the order takes effect; and

(b) specifies the minimum discount to be applied to full adult fares paid by means of a Metro Greencard; and

(c) revokes the Government Prices Oversight (Metro Bus Fares) Order 2009 .
