Criminal Investigation (Extra-Territorial Offences) Regulations 2013

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Criminal Investigation (Extra-Territorial Offences) Act 1987 .

1.   Short title

These regulations may be cited as the Criminal Investigation (Extra-Territorial Offences) Regulations 2013 .

2.   Commencement

These regulations take effect on 24 December 2013.

3.   Interpretation

In these regulations –
Act means the Criminal Investigation (Extra-Territorial Offences) Act 1987 .

4.   Application of police officer

An application of a police officer under section 4 of the Act is to be in accordance with Schedule 1 .

5.   Search warrant

A search warrant issued by a magistrate under section 4 of the Act is to be in accordance with Schedule 2 .

6.   Notice of execution of search warrant

A notice given by a police officer under section 5(6)(a) of the Act is to be in accordance with Schedule 3 .

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe forms for the purposes of the Criminal Investigation (Extra-Territorial Offences) Act 1987 ; and
(b) are made consequentially on the repeal of the Criminal Investigation (Extra-Territorial Offences) Regulations 2003 under section 11 of the Subordinate Legislation Act 1992 .
