Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Concession Eligibility) Regulations 2013

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Concession Eligibility) Regulations 2013 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of dolly the following definition:
eligible asylum seeker means –
(a) the holder of a Bridging (Class WE) (Subclass 050 or 051) visa granted under section 73 of the Migration Act 1958 of the Commonwealth; and
(b) a person who is subject to a residence determination that has been made under section 197AB of the Migration Act 1958 of the Commonwealth;

5.    Regulation 116 amended (Rebate for pensioner or eligible asylum seeker)

Regulation 116 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1)(a) "or eligible asylum seeker" after "pensioner";
(b) by inserting in subregulation (2) "or eligible asylum seeker" after "pensioner";
(c) by inserting in subregulation (3)(a) "or eligible asylum seeker" after "pensioner";
(d) by inserting in subregulation (3)(b) "or eligible asylum seeker" after "pensioner".

6.    Regulation 122 amended (Road safety levy)

Regulation 122(3) of the Principal Regulations is amended as follows:
(a) by inserting in paragraph (a) "or eligible asylum seeker" after "pensioner";
(b) by inserting in paragraph (b) "or eligible asylum seeker" after "pensioner".

7.    Regulation 133 amended (Limitation on concessional registration payments for eligible pensioners and eligible asylum seekers)

Regulation 133 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "or eligible asylum seeker" after "pensioner";
(b) by inserting "or eligible asylum seeker" after "pensioner" in the definition of concessional registration payment in subregulation (2) .

8.    Regulation 134 amended (Limitation on concessional administrative fee for eligible pensioners and eligible asylum seekers)

Regulation 134 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (1) "or eligible asylum seeker" after "pensioner";
(b) by inserting "or eligible asylum seeker" after "pensioner" in the definition of concessional administrative fee in subregulation (2) .

9.    Schedule 1 amended (Fees)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting items 2 , 3 and 4 and substituting the following:

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 to afford an eligible asylum seeker the same rebates and concessions as a pensioner under those regulations.
