Vehicle and Traffic (Vehicle Operations) Amendment Regulations (No. 2) 2010

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Vehicle Operations) Amendment Regulations (No. 2) 2010 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Vehicle Operations) Regulations 2001 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended by omitting "published in the Gazette" from the definition of Gazette notice and substituting "made".

5.    Regulation 43 amended (Interpretation of Part)

Regulation 43(1) of the Principal Regulations is amended by omitting "notice contained in the Gazette" and substituting "Gazette notice".

6.    Regulation 45 amended (Gazette notices)

Regulation 45 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) "published in the Gazette";
(b) by inserting the following subregulation after subregulation (2) :
(3)  A notice under this regulation is a statutory rule for the purposes of the Rules Publication Act 1953 .

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Vehicle Operations) Regulations 2001 by –
(a) removing the requirement for a notice made under the regulations to be published in full in the Gazette; and
(b) requiring the making of such a notice to be notified in the Gazette.
