Fluoridation (Interim) Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Fluoridation Committee, make the following regulations under the Fluoridation Act 1968 .

1.   Short title

These regulations may be cited as the Fluoridation (Interim) Regulations 2009 .

2.   Commencement

These regulations take effect on 17 March 2009.

3.   Interpretation

In these regulations –
Act means the Fluoridation Act 1968 ;
recognised laboratory means a laboratory that is accredited by the National Association of Testing Authorities, Australia.

4.   Record-keeping

A water supply authority having the control of a fluoridated water supply must keep the following records for the purposes of the Act:
(a) a record of the volume of water treated each day by the authority;
(b) a record of the stock of fluoride that the authority has on hand each day;
(c) a record of the quantity of fluoride added to that water supply each day by the authority;
(d) a record of the results of analyses and tests of samples of water taken by the authority from that water supply;
(e) a record of the calculated content of fluoride in that water supply.
Penalty:  Fine not exceeding 5 penalty units.

5.   Analyses and tests

(1)  A water supply authority having the control of a fluoridated water supply is to take samples from that water supply, for the purpose of making analyses and tests of those samples, from such points on the reticulation system of that water supply as the Committee determines.
(2)  The analyses and tests of the samples are to be of such nature and made at such frequency as the Committee determines.
(3)  The analyses and tests of the samples are to be made using reagent solution prepared within the previous 6 months by a person or persons approved by the Committee.
(4)  The water supply authority is to send details of the results of the analyses and tests taken in any month to the Committee by the 15th day of the following month.
(5)  The water supply authority is to cause the Government Analyst or an analyst from a recognised laboratory to analyse and test a sample –
(a) once a month; or
(b) more frequently if directed to do so by the Committee.
(6)  A water supply authority must notify the Committee within 24 hours of receiving the result of any analysis or test showing excess fluoride in a fluoridated water supply under its control.
Penalty:  Fine not exceeding 5 penalty units.

6.   Certification of fluoride supplies

(1)  The Committee is to appoint an inspector for the purpose of –
(a) inspecting any fluoride a water supply authority proposes to add to a public water supply; and
(b) certifying whether or not that fluoride is fit for use in a public water supply.
(2)  A water supply authority must not add any fluoride to a public water supply unless the authority holds a certificate of inspection issued by an inspector certifying that the fluoride to be so used is fit for use in a public water supply.
Penalty:  Fine not exceeding 5 penalty units.

7.   Regulations to be displayed

A water supply authority having the control of a fluoridated water supply is to display a copy of these regulations in a conspicuous position in the vicinity of the fluoridation works of that authority.

(This note is not part of the regulation)

These regulations –
(a) set out the procedures and requirements to be observed by water supply authorities that have control of fluoridated water supplies; and
(b) are made consequentially on the repeal of the Fluoridation Regulations 1999 under section 11 of the Subordinate Legislation Act 1992 .
