I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Community Transport) Regulations 2008 .

2.   Commencement

These regulations take effect on 1 January 2009.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations.

4.    Regulation 38A amended (Exemptions for certain driving instructors)

Regulation 38A(b) of the Principal Regulations is amended by omitting "1 January 2009" and substituting "1 January 2010".

5.    Regulation 40A amended (Exemptions for certain public passenger vehicle drivers)

Regulation 40A(1) of the Principal Regulations is amended as follows:
(a) by inserting "that is a small passenger vehicle" after "a public passenger vehicle";
(b) by omitting from paragraph (b) "1 January 2009" and substituting "1 January 2010".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 by – 
(a) extending, until 1 January 2010, the period of the temporary exemption for certain driving instructors and drivers providing community transport services from the requirement to hold an ancillary certificate under the Vehicle and Traffic Act 1999 ; and
(b) revising the scope of that exemption for drivers providing community transport services.
