Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 7 of the Mutual Recognition (Tasmania) Act 1993 .

1.   Short title

These regulations may be cited as the Mutual Recognition (Tasmania) Temporary Exemptions Regulations 2007 .

2.   Commencement

These regulations take effect on 1 August 2007.

3.   Interpretation

In these regulations, unless the contrary intention appears –
State Act means the Mutual Recognition (Tasmania) Act 1993 ;
tobacco product means tobacco product as defined in the Public Health Act 1997 .

4.   Temporary exemptions for tobacco products

For the purposes of section 15 of the Commonwealth Act as adopted by the State Act –
(a) tobacco products are declared to be goods to which section 15 of the Commonwealth Act applies; and
(b) the Public Health Act 1997 , to the extent that it deals with tobacco products, is declared to be a law to which section 15 of the Commonwealth Act applies.

5.   Expiry

These regulations expire on 31 July 2008.

These regulations are administered in the Department of Treasury and Finance.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) declare tobacco products to be goods to which section 15 of the Mutual Recognition Act 1992 of the Commonwealth applies; and
(b) declare the Public Health Act 1997 , to the extent that it deals with tobacco products, to be a law to which section 15 of the Mutual Recognition Act 1992 of the Commonwealth applies; and
(c) expire on 31 July 2008.
