Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Inspection) Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Inspection) Regulations 2007 .

2.   Commencement

These regulations take effect on 2 April 2007.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended as follows:
(a) by omitting the definition of applicable scheduled fee and substituting the following definition:
applicable scheduled fee means a fee specified in Schedule 1 in respect of a matter described in that Schedule and includes any additional fee specified in Schedule 1 in respect of that matter;
(b) by inserting the following definition after the definition of relevant vehicle standards :
remote vehicle inspection means an inspection that is carried out at a place other than the business premises of the person carrying out the inspection and is –
(a) carried out under section 50 of the Act by a person, other than a police officer or an authorised officer, who is approved by the Registrar to carry out the inspection; or
(b) carried out under regulation 46(2) by a person, other than an authorised officer, who is approved by the Registrar to carry out the inspection; or
(c) carried out under regulation 48(3) by a person to whom the Registrar has delegated a power to carry out the inspection; or
(d) carried out under regulation 71(2) by a person, other than a police officer or an authorised officer, who is authorised by the Registrar to carry out the inspection; or
(e) carried out under regulation 85 by a person, other than a police officer or an authorised officer, who is approved by the Registrar to carry out the inspection;

5.    Regulation 39 amended (Requirements for motor vehicles used in driving instruction)

Regulation 39(4)(b) of the Principal Regulations is amended by omitting "6 months" and substituting "12 months".

6.    Regulation 46 amended (Compliance with relevant vehicle standards)

Regulation 46(2) of the Principal Regulations is amended by inserting "an authorised officer or a person approved by" after " subregulation (1) ,".

7.    Schedule 1 amended (Fees)

Schedule 1 to the Principal Regulations is amended as follows:
(a) by omitting item 32 and substituting the following item:

Note: This item extends to any inspection carried out under the Act or these regulations except the following:

 

(a) an inspection carried out in relation to an application for registration, or renewal of registration, of a vehicle;

 

(b) an inspection related to the clearance of a vehicle defect notice;

 

(c) an inspection carried out under a vehicle inspection program.

Inspection fees in the case of an inspection under a vehicle inspection program of –

 

VT 50(9) DLVR 85(8)

 

(a) a large passenger vehicle that is registered as a public passenger vehicle or a hire and drive vehicle –

  
 

(i) if a brake efficiency test is carried out as part of the inspection

35 plus 30 for each vehicle axle tested

 
 

(ii) if a brake efficiency test is not carried out as part of the inspection

(b) a small passenger vehicle that is registered as a public passenger vehicle

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 by –
(a) extending the term for which certain certificates of roadworthiness are to be issued; and
(b) providing that authorised officers and certain approved persons, rather than the Registrar of Motor Vehicles, may inspect vehicles and issue certain certificates of compliance for those vehicles; and
(c) further providing for the fees payable under the Vehicle and Traffic Act 1999 .
