Consumer Credit (Tasmania) (Jurisdiction of Courts) Regulations 2006

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 8 of the Consumer Credit (Tasmania) Act 1996 .

1.   Short title

These regulations may be cited as the Consumer Credit (Tasmania) (Jurisdiction of Courts) Regulations 2006 .

2.   Commencement

These regulations take effect on 31 October 2006.

3.   Interpretation

In these regulations –
Code means the Consumer Credit (Tasmania) Code.

4.   Jurisdiction of courts

(1)  For the purposes of the following provisions of the Code, a reference to "the Court" or "a court" is taken to include a reference to the Supreme Court or Magistrates Court:

(2)  The jurisdiction conferred on a court by subregulation (1) is subject to the court's monetary jurisdictional limit but is not subject to the court's other jurisdictional limits.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) prescribe which courts have jurisdiction in respect of certain provisions of the Consumer Credit (Tasmania) Code; and
(b) are made consequentially on the repeal of the Consumer Credit (Tasmania) (Jurisdiction of Courts) Regulations 1996 under section 11 of the Subordinate Legislation Act 1992 .
