Workers' (Occupational Diseases) Relief Fund Regulations 2006

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Workers' (Occupational Diseases) Relief Fund Act 1954 .

1.   Short title

These regulations may be cited as the Workers' (Occupational Diseases) Relief Fund Regulations 2006 .

2.   Commencement

These regulations take effect on 25 September 2006.

3.   Interpretation

In these regulations –
Act means the Workers' (Occupational Diseases) Relief Fund Act 1954 .

4.   Manner of applying for compensation

For section 22(9) of the Act, an application for compensation is to –
(a) be in writing; and
(b) be addressed to the Secretary; and
(c) specify –
(i) the name and address of the claimant; and
(ii) the name of the employer at the time of incapacity; and
(iii) the grounds for the claim for compensation.

5.   Manner of appealing to medical referee

(1)  For section 32(1) of the Act, an appeal to a medical referee is to –
(a) be in writing; and
(b) be addressed to the Secretary; and
(c) specify –
(i) the name and address of the appellant; and
(ii) the name of the certifying medical officer; and
(iii) the date of the certificate appealed against; and
(iv) the grounds of the appeal.
(2)  On receiving an appeal, the Secretary is to –
(a) refer it to a medical referee; and
(b) inform the appellant of the name of the medical referee to whom the appeal is referred.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations, which replace the Workers (Occupational Diseases) Relief Fund Regulations 1996 consequent on their repeal under the Subordinate Legislation Act 1992 , prescribe –
(a) the manner of applying for compensation under the Workers' (Occupational Diseases) Relief Fund Act 1954 ; and
(b) the manner of appealing to a medical referee against a certificate given under that Act.
