Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Heavy Vehicle Licences) Regulations 2006

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Heavy Vehicle Licences) Regulations 2006 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of small passenger vehicle the following definition:
testing officer means any of the following persons who is testing or assessing a driver for the purposes of these regulations:
(a) a police officer;
(b) an authorised officer;
(c) a person acting on behalf of the Registrar;
(d) a person –
(i) employed, contracted or otherwise connected with an organisation that has a contract with the Department to provide testing; and
(ii) who tests the driver in accordance with the contract;

5.    Regulation 8 amended (Learner licences)

Regulation 8(7) of the Principal Regulations is amended as follows:
(a) by omitting subparagraph (ii) from paragraph (a) and substituting the following subparagraph:
(ii) a testing officer who is testing or assessing the driver for the purposes of these regulations; and
(b) by omitting from paragraph (ab)(ii) "person" and substituting "testing officer";
(c) by inserting in paragraph (b) "the testing officer" after "driver, or";
(d) by inserting in paragraph (c) "the testing officer" after "driver, or".

6.    Regulation 13 amended (Requirements by Registrar)

Regulation 13 of the Principal Regulations is amended by omitting subregulation (6) and substituting the following subregulation:
(6)  The fee payable for a test or assessment required by the Registrar under this regulation is –
(a) in the case of a practical driving test for a heavy vehicle licence and ancillary certificate –
(i) the fee specified by the organisation that has a contract with the Department to provide the test; or
(ii) if the test is not undertaken by such an organisation, the applicable scheduled fee; or
(b) in all other cases, the applicable scheduled fee.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 by –
(a) allowing organisations contracted to the Department to provide testing officers for certain driving tests; and
(b) making consequential amendments.
