Vehicle and Traffic (Vehicle Standards) Amendment Regulations 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Vehicle Standards) Amendment Regulations 2002 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Vehicle Standards) Regulations 2001 are referred to as the Principal Regulations.

4.    Regulation 4 amended (Vehicle Standards offences)

Regulation 4(2)(a)(i) of the Principal Regulations is amended by omitting " Traffic (Vehicle Loads and Dimensions) Regulations 1975 " and substituting " Vehicle and Traffic (Vehicle Operations) Regulations 2001 ".

5.    Regulation 105 amended (Fitting of warning lights and signs)

Regulation 105 of the Principal Regulations is amended as follows:
(a) by omitting paragraph (b) from subregulation (2) and substituting the following paragraph:
(b) with the edge of the warning sign not more than 100 millimetres from the nearest point on the lens of the warning lights or, if that is not practicable, not more than 200 millimetres from the nearest point on the lens; and
(b) by omitting subregulation (4) and substituting the following subregulation:
(4)  The warning lights at the same end of the bus must be fitted at the same height and as high as practicable.
(c) by inserting the following subregulation after subregulation (6) :
(7)  Subregulation (2)(b) does not apply if the warning lights fitted to the front of the bus are mounted higher than 1.8 metres above the ground level.

6.    Regulation 107 amended (Specifications for warning signs)

Regulation 107 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1)(a) "words "SCHOOL BUS"" and substituting "word or words "SCHOOL" or "SCHOOL BUS"";
(b) by omitting from subregulation (1)(b) "230" and substituting "165";
(c) by omitting from subregulation (3) "and subregulation (2) ";
(d) by omitting from subregulation (3)(a)(ii) "400" and substituting "300";
(e) by omitting from subregulation (3)(a)(ii) "250" and substituting "200";
(f) by inserting the following subregulation after subregulation (3) :
(4)  The warning sign mentioned in subregulation (2) must –
(a) be a rectangular shape at least –
(i) if warning lights are on the warning sign, 550 millimetres wide and 400 millimetres high; and
(ii) in any other case, 400 millimetres wide and 250 millimetres high; and
(b) have a black border; and
(c) have black graphics and be coated with yellow retro-reflective material of class 1 or 2 that meets Australian Standard AS 1906 Retro-reflective Materials and Devices for Road Traffic Control Purposes.

7.    Regulation 108 amended (Other lights and reflectors)

Regulation 108(1) of the Principal Regulations is amended by omitting " Traffic (Vehicle Loads and Dimensions) Regulations 1975 " from paragraph (b) of the definition of special-use vehicle and substituting " Vehicle and Traffic (Vehicle Operations) Regulations 2001 ".

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Vehicle and Traffic (Vehicle Standards) Regulations 2001 by –
(a) deleting references to superseded regulations; and
(b) amending regulations in relation to warning lights and signs on buses carrying school children.
