Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Disqualified Drivers) Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .

1.   Short title

These regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Disqualified Drivers) Regulations 2001 .

2.   Commencement

These regulations take effect on the day on which the Vehicle and Traffic Amendment (Excessive Speeding and Disqualified Drivers) Act 2001 commences.

3.   Principal Regulations

In these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations.

4.    Regulation 9 amended (Provisional licences)

Regulation 9(4) of the Principal Regulations is amended as follows:
(a) by omitting from paragraph (a)(iii) "3 months or more" and substituting "more than 4 months";
(b) by omitting from paragraph (b)(iii) "less than 3 months" and substituting "4 months or less";
(c) by omitting from paragraph (b)(iv) "3 months or more" and substituting "more than 4 months".

5.   Regulation 11 amended (Eligibility)

Regulation 11 of the Principal Regulations is amended as follows:
(a) by inserting in subregulation (3)(a)(ii) "or by the operation of an automatic statutory penalty" after "court";
(b) by inserting in subregulation (5)(a)(i) "or by the operation of an automatic statutory penalty" after "court".

6.    Regulation 14 amended (Issue of driver licence)

Regulation 14(10) of the Principal Regulations is amended by inserting "or by the operation of an automatic statutory penalty" after "court".

7.    Regulation 31 amended (Interstate and international drivers)

Regulation 31(2)(a) of the Principal Regulations is amended by inserting ", by the operation of an automatic statutory penalty" after "court".

8.    Regulation 38 amended (Eligibility to hold ancillary certificate in driving instruction)

Regulation 38(2)(a)(i) of the Principal Regulations is amended by inserting "or by the operation of an automatic statutory penalty" after "court".

9.    Regulation 40 amended (Eligibility to hold ancillary certificate to drive public passenger vehicle)

Regulation 40(2)(a)(i) of the Principal Regulations is amended by inserting "or by the operation of an automatic statutory penalty" after "court".

10.    Regulation 42 amended (Return of driver licence or ancillary certificate on suspension or cancellation)

Regulation 42(3) of the Principal Regulations is amended by inserting "or by the operation of an automatic statutory penalty" after "court".

These regulations make certain amendments to the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 consequent on the enactment of the Vehicle and Traffic Amendment (Excessive Speeding and Disqualified Drivers) Act 2001.
