Traffic (General and Local) Amendment Regulations 2000

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

1.   Short title

These regulations may be cited as the Traffic (General and Local) Amendment Regulations 2000 .

2.   Commencement

These regulations take effect on the day on which the Vehicle and Traffic Act 1999 commences.

3.   Principal Regulations

In these regulations, the Traffic (General and Local) Regulations 1956 are referred to as the Principal Regulations.

4.   Regulation 8 amended (Offences)

Regulation 8 of the Principal Regulations is amended by omitting subregulation (12) and substituting the following subregulation:
(12)  A person must not be in or on, tamper with or damage a motor vehicle on a public street unless the person is authorised by the registered operator or has other lawful authority.

5.   Regulation 8E amended (Driving hours)

Regulation 8E of the Principal Regulations is amended by omitting from subregulation (3) "a person who owns or is in charge of a prescribed vehicle" and substituting "the registered operator or other person in charge of a prescribed vehicle".

6.   Regulation 8F amended (Logbooks)

Regulation 8F of the Principal Regulations is amended as follows:
(a) by omitting from the definition of "prescribed vehicle driver" in subregulation (1) "whether as an owner-driver, employee, agent or in any other capacity" and substituting "whether as a registered operator, employee or agent or in any other capacity";
(b) by omitting from subregulation (4) "owner" and substituting "registered operator".

7.   Regulation 14AA amended (Flashing or rotating lights not to be used except in certain cases)

Regulation 14AA of the Principal Regulations is amended as follows:
(a) by omitting subregulation (2) and substituting the following subregulation:
(2)  Notwithstanding subregulation (1), a vehicle may show a flashing or rotating red light when it is being driven, or is standing, on a public street if the vehicle is –
(a) operated by, or under the authority of, a council for the purposes of firefighting; or
(b) operated by a person appointed or employed under section 7(1) or (3) of the National Parks and Wildlife Act 1970 for the purposes of firefighting; or
(c) operated by the Hydro-Electric Corporation and proceeding to the scene of a fire or accident for the purpose of attending to powerlines; or
(d) operated as an emergency vehicle by the State Emergency Service; or
(e) operated by a company established under the Port Companies Act 1997 and ordinarily used within the boundaries of a port for which the company is established; or
(f) operated by a military force of the Commonwealth for purposes related to defence; or
(g) operated as a prison escort vehicle by a department or authority responsible for the transportation of prisoners.
(b) by omitting from the definition of "tow truck" in subregulation (5) "owned or".

8.   Regulation 16A amended (Use, &c., of vehicles converted, &c., to use liquefied petroleum gas)

Regulation 16A of the Principal Regulations is amended by omitting paragraph (a) of subregulation (1AA) and substituting the following paragraph:
(a) the responsible department in relation to the Dangerous Goods Act 1998 ;

9.   Regulation 17B amended (Motor vehicles not to draw other vehicles except in certain cases)

Regulation 17B of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (4)(a)(ii) "owned and";
(b) by omitting subregulation (7).

10.   Regulation 19A amended (Motor vehicles with left-hand drive prohibited except in certain cases)

Regulation 19A of the Principal Regulations is amended as follows:
(a) by omitting from paragraph (c) of subregulation (2) "or restrictions";
(b) by omitting paragraph (b) of subregulation (3) and substituting the following paragraph:
(b) is used pursuant to section 28 or 29 of the Vehicle and Traffic Act 1999 ;
(c) by omitting paragraphs (e) and (f) of subregulation (3) and substituting the following paragraphs:
(e) is registered under regulation 51 of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000; or
(f) is used under the authority of a short term unregistered vehicle permit issued under regulation 75 of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000.
