Stamp Duties Amendment (Vehicle and Traffic) Regulations 2000

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Stamp Duties Act 1931 .

1.   Short title

These regulations may be cited as the Stamp Duties Amendment (Vehicle and Traffic) Regulations 2000 .

2.   Commencement

These regulations take effect on the day on which the Vehicle and Traffic Act 1999 commences.

3.   Principal Regulations

In these regulations, the Stamp Duties Regulations 1998 are referred to as the Principal Regulations.

4.    Part 3, Division 7: Heading amended

Division 7 of Part 3 of the Principal Regulations is amended by omitting " Traffic Act 1925 " from the heading to that Division and substituting "Vehicle and Traffic Act 1999".

5.    Regulation 14 amended (Applications to which section 74 of Act applies)

Regulation 14(4) of the Principal Regulations is amended by omitting paragraph (d) and substituting the following paragraph:

(d) the Registrar of Motor Vehicles.

6.    Regulation 17 substituted

Regulation 17 of the Principal Regulations is rescinded and the following regulation is substituted:

17.   Forms

(1)  The forms specified in Schedule 1 are prescribed for the purpose of the Act.

(2)  A document in a form prescribed by these regulations as in force before the commencement of the Stamp Duties Amendment (Vehicle and Traffic) Regulations 2000 is taken to conform with these regulations, despite amendment to the form by those amending regulations, if the document is created or made within 12 months after the commencement of those amending regulations.

7.   Schedule 1 amended

Schedule 1 to the Principal Regulations is amended as follows:

(a) by omitting from Form 8 "Traffic Act 1925" and substituting "Vehicle and Traffic Act 1999";

(b) by omitting from Form 8 "Full name of owner" and substituting "Full name of registered operator";

(c) by omitting from Form 9 "Traffic Act 1925" and substituting "Vehicle and Traffic Act 1999";

(d) by omitting from Form 10 "Traffic Act 1925" and substituting "Vehicle and Traffic Act 1999";

(e) by omitting from Form 10 "Full name of owner" and substituting "Full name of registered operator".
