Coroners (Fees, Expenses and Allowances) Regulations 2026
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Coroners Act 1995 .

These regulations may be cited as the Coroners (Fees, Expenses and Allowances) Regulations 2026 .
These regulations take effect on 22 June 2026.
In these regulations Act means the Coroners Act 1995 ;Chief Magistrate has the same meaning as in the Magistrates Court Act 1987 ;GST has the same meaning as in the A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth;motor vehicle has the same meaning as in the Vehicle and Traffic Act 1999 ;Tasmanian State Service Award means the Tasmanian State Service Award made under the Industrial Relations Act 1984 in respect of State Service employees and State Service officers;witness means a witness in an inquest.
For the purposes of the Act, the fees specified in Part 1 of Schedule 1 (a) are prescribed as the fees that are payable under the Act in respect of the matters to which they relate; and(b) are GST inclusive.
5. Expenses and allowances payable to witnesses
(1) In this regulation CPI figure for Hobart means the Consumer Price Index (All Groups) Number for Hobart published by the Australian Statistician under the authority of the Census and Statistics Act 1905 of the Commonwealth;miscellaneous allowance means an allowance specified in Division 2 of Part 2 of Schedule 1 ;percentage change, in relation to a financial year, means the percentage change between (a) the average of the CPI figures for Hobart in respect of the 4 quarters ending on 31 December immediately preceding the financial year; and(b) the average of the CPI figures for Hobart in respect of the 4 quarters ending on 31 December immediately preceding the 4 quarters referred to in paragraph (a) ;specified expense and allowance means an expense and allowance specified in Division 1 of Part 2 of Schedule 1 ;subsequent financial year means a financial year after the financial year that ends on 30 June 2027.(2) For the purposes of the Act and subject to subregulation (4) , an amount of a specified expense and allowance that is payable under the Act to a witness is (a) for the financial year ending on 30 June 2026, the amount specified in Division 1 of Part 2 of Schedule 1 in respect of the specified expense and allowance; and(b) for the financial year ending on 30 June 2027, the amount specified in Division 1 of Part 2 of Schedule 1 in respect of the specified expense and allowance; and(c) for a subsequent financial year (i) the amount calculated by increasing the amount of the specified expense and allowance for the immediately preceding financial year by the percentage change for the subsequent financial year; or(ii) if an amount calculated under subparagraph (i) for a financial year is less than the amount of the specified expense and allowance for the immediately preceding financial year, the amount of the specified expense and allowance for that immediately preceding financial year.(3) For the purposes of the Act and subject to subregulation (4) , an amount of a miscellaneous allowance that is payable under the Act to a witness is the amount specified in Division 2 of Part 2 of Schedule 1 in respect of the miscellaneous allowance.(4) For the purposes of the Act, the Chief Magistrate may (a) determine that a professional or expert witness is to be (i) paid an expense and allowance that is equal to or greater than the specified expense and allowance calculated under subregulation (2) ; or(ii) paid a miscellaneous allowance that is equal to or greater than the miscellaneous allowance calculated under subregulation (3) ; and(b) determine the amount that is to be paid to the witness.
6. State Service employees and officers not entitled to additional remuneration
Regulation 5 does not apply to a State Service employee or State Service officer who is entitled to full pay under any of the following while the employee or officer attends as a witness:(a) the State Service Act 2000 ;(b) an award or industrial agreement;(c) the persons instrument of appointment.
