Juries Regulations 2025
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Juries Act 2003 .

These regulations may be cited as the Juries Regulations 2025 .
These regulations take effect on 9 December 2025.
In these regulations Act means the Juries Act 2003 ;relevant person means a person who attends for jury service in response to a summons or as a supplementary juror.
(1) For section 53 of the Act, a relevant person is entitled to be paid, in addition to any remuneration the person is entitled to be paid under these regulations, a travel allowance for private vehicle use for the purposes of attendance for jury service at the same rate as the allowance prescribed by (a) clause 3(d)(ii) and (iii) of Part IV of the Tasmanian State Service Award No. 1 of 2025; or(b) if the Tasmanian State Service Award is subsequently varied the provisions of that award that substantially correspond to the provisions referred to in paragraph (a) .(2) In this regulation Tasmanian State Service Award means the award of that name made or varied under the Industrial Relations Act 1984 .
5. Remuneration for unemployed persons
For sections 53 and 68(2)(a) of the Act, a relevant person who is not employed is entitled to be paid the following remuneration (a) if the person is not empanelled for a jury $25 for each day or part of a day the person attends for jury service; or(b) if the person is empanelled for a jury (i) $25 for each part of a day, not exceeding half a day, the person attends for jury service; and(ii) for the first 3 days the person attends for jury service for longer than half a day $40 for each day; and(iii) for each additional day the person attends for jury service for longer than half a day $50 for each day.
6. Remuneration for employed persons
(1) For sections 53 and 68(2)(a) of the Act, a relevant person who is an employee or is self-employed is entitled to be paid the remuneration specified in subregulation (3) if the person satisfies the Sheriff that the person has suffered loss of salary, wages or income, or other monetary loss, as a result of the persons attendance for jury service.(2) For the purposes of subregulation (1) , the Sheriff may require the person to produce (a) if the person is an employee a certificate from the persons employer certifying, or other evidence, that the person (i) has suffered loss of salary, wages or income; or(ii) would otherwise have been rostered for work on a day the person attended for jury service; or(b) if the person is self-employed a statutory declaration verifying, or other evidence, that the person has suffered loss of income or other monetary loss.(3) Subject to subregulation (4) , the remuneration payable if the Sheriff is satisfied of the matter referred to in subregulation (1) is an amount equal to (a) for an employee the amount of the loss of salary, wages or income, for each day or part of a day the person attends for jury service; or(b) for a self-employed person the amount of the loss of income, or other monetary loss, for each day or part of a day the person attends for jury service.(4) The remuneration payable must not exceed the amount calculated in accordance with the following formula:where R is the maximum remuneration payable for the financial year during which the person attends for jury service;A is the last published average weekly earnings as at 1 January of the financial year immediately preceding the financial year during which the person attends for jury service;B is the average weekly earnings for February in 2008.(5) In this regulation average weekly earnings means the seasonally adjusted average weekly total earnings for a full-time adult employee in Australia as published by the Australian Bureau of Statistics from time to time.
7. State Service employees and officers not entitled to additional remuneration
Regulation 6 does not apply to an employee or officer of the State Service, within the meaning of the State Service Act 2000 , who is entitled to full pay under any of the following while the employee or officer attends for jury service:(a) that Act, or regulations made under that Act;(b) an award or industrial agreement;(c) the persons instrument of appointment.
