Vehicle and Traffic (Vehicle Operations) (Pig Trailers Transporting Light Aircraft) Notice 2024
The Transport Commission makes the following notice under regulation 35 of the Vehicle and Traffic (Vehicle Operations) Regulations 2024 .
This notice may be cited as the Vehicle and Traffic (Vehicle Operations) (Pig Trailers Transporting Light Aircraft) Notice 2024 .
This notice takes effect on 1 December 2024.
(1) In this notice light aircraft means (a) an aircraft that (i) is able to be transported on a light aircraft pig trailer; and(ii) cannot be compacted, or disassembled, into parts, or components, such that the entire compacted or disassembled aircraft can be transported by use of a light vehicle other than a light aircraft pig trailer; or(b) part of an aircraft referred to in paragraph (a) ;light aircraft pig trailer means a pig trailer that is built and used for the purposes of transporting (a) a light aircraft; or(b) equipment associated with a light aircraft;Vehicle Operations Regulations means the Vehicle and Traffic (Vehicle Operations) Regulations 2024 .(2) Unless the contrary intention appears, a word or phrase that is defined in the Vehicle and Traffic Act 1999 or the Vehicle Operations Regulations and used in this notice has the same meaning in this notice as defined in that Act or in those regulations.(3) The Acts Interpretation Act 1931 applies to the interpretation of this notice as if it were rules within the meaning of that Act.
An exemption specified in this notice (a) applies to all areas of the State; and(b) applies at all times of the day; and(c) remains in force for a period of 3 years commencing on the date on which this notice takes effect.
5. Exemption of light aircraft pig trailer
(1) In this clause down force, in relation to a light aircraft pig trailer connected to a tow vehicle, means the transfer of downward vertical force from the trailer to the towbar of the vehicle;oversize vehicle sign means an oversize vehicle warning sign in accordance with Divisions 1 and 2 of Part 2 of Schedule 2 to the Vehicle Operations Regulations.(2) Subject to the conditions specified in subclause (3) , regulations 13 and 14(3) of the Vehicle Operations Regulations do not apply to a person using, or causing or permitting the use of, a light aircraft pig trailer.(3) The exemption under subclause (2) is subject to the following conditions:(a) the light aircraft pig trailer must only be towed by a light vehicle;(b) the light aircraft pig trailer must not be used to transport a load that is not (i) a light aircraft; or(ii) a light aircraft and equipment associated with that light aircraft;(c) the light aircraft pig trailer must, at all times when connected to and being towed by the vehicle, exert down force;(d) the rear overhang of the light aircraft pig trailer, inclusive of its load, must not exceed 5 metres;(e) subject to subclause (4) , if the rear overhang of the light aircraft pig trailer exceeds 3.7 metres, inclusive of its load, the part of the rear overhang of the trailer that exceeds 3.7 metres must not be more than 2 metres wide;(f) if the rear overhang of the light aircraft pig trailer, inclusive of its load, exceeds 3.7 metres, an oversize vehicle sign must be displayed at the front and rear of the combination;(g) the combined length of the light aircraft pig trailer, inclusive of its load and the motor vehicle towing it, must not exceed 25 metres;(h) if the combined length of the light aircraft pig trailer, inclusive of its load and the motor vehicle towing it, exceeds 22 metres, it must (i) display an oversize vehicle sign at the front and rear of the combination; and(ii) display warning lights if used at night;(i) the vehicle used to tow the light aircraft pig trailer must operate its headlights on low beam when towing the trailer during daylight hours;(j) if the light aircraft pig trailer or combination is used in daylight, a red flag must be affixed to the rearmost point of its load;(k) the light aircraft pig trailer must display side markers and rear markers for night travel in accordance with clause 6 of Schedule 1 to the Vehicle Operations Regulations.(4) Subclause (3)(e) does not apply to a person using, or causing or permitting the use of, a light aircraft pig trailer with a rear overhang that exceeds 3.7 metres, inclusive of its load, if (a) immediately before the commencement of this notice, the light aircraft pig trailer was registered under the Vehicle and Traffic Act 1999 ; and(b) on and after the commencement of this notice, the light aircraft pig trailer is registered under the Vehicle and Traffic Act 1999 ; and(c) at no point, since the commencement of this notice, has the light aircraft pig trailer been unregistered.
