I make the following rules under section 22 of the Electronic Conveyancing National Law (Tasmania) .

1.   Short title

These rules may be cited as the Electronic Conveyancing National Law (Tasmanian Operating Requirements) Rules 2023 .

2.   Commencement

These rules take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

(1)  In these rules –
Act means the Electronic Conveyancing National Law (Tasmania) ;
model operating requirements means the model operating requirements from time to time developed and published by ARNECC within the meaning of the Act.
(2)  Unless the contrary intention appears, a word or expression used in these rules that is also used in the Electronic Conveyancing (Adoption of National Law) Act 2013 has the same meaning in these rules as it has in that Act.

4.   Tasmanian operating requirements

(1)  For the purposes of section 22 of the Act, the operating requirements determined under that section, for the purposes of the Act, are the requirements set out in the model operating requirements.
(2)  The operating requirements determined under subrule (1) take effect 20 business days after the operating requirements are published by the Registrar on a public website maintained by, or on behalf of, the Department.

5.   Substitution of model operating requirements

For the purposes of the Act, any substitution, published by ARNECC within the meaning of the Act, of the model operating requirements –
(a) is taken to be a substitution of the operating requirements determined under rule 4 ; and
(b) is determined to be operating requirements under section 22 of the Act in accordance with rule 4 as so substituted; and
(c) takes effect 20 business days after the substituted operating requirements are published by the Registrar on a public website maintained by, or on behalf of, the Department.

6.   Publication of draft does not constitute publication of requirements

For the avoidance of doubt, publication by the Registrar of a consultation or exposure draft of operating requirements does not constitute publication for the purposes of these rules.
