I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Crown Lands (Shack Sites) Act 1997 .

1.   Short title

These regulations may be cited as the Crown Lands (Shack Sites) Regulations 2022 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Interpretation

In these regulations –
Act means the Crown Lands (Shack Sites) Act 1997 ;
CPI figure for Hobart means the Consumer Price Index: All Groups Index Number for Hobart published by the Australian Statistician under the authority of the Census and Statistics Act 1905 of the Commonwealth;
land value of the shack site as at 2007 means the land value that was in force for the shack site as at 1 July 2007 as determined by the Valuer-General under the Valuation of Land Act 2001 .

4.   Rental for replacement lease

(1)  For the purposes of section 17 of the Act, the rental for a replacement lease for a shack site for the rental year commencing on 1 September 2010 is the lesser of the following:
(a) $1 500;
(b) 2% of the land value of the shack site as at 2007.
(2)  For the purposes of section 17 of the Act, the rental for a replacement lease for a shack site for each subsequent rental year is the amount calculated in accordance with the following formula:

where:
A is the rental in dollars for the subsequent rental year being calculated;
B is the rental determined under subregulation (1) ;
C is the CPI figure for Hobart for the quarter ending on 30 June immediately preceding the commencement of the subsequent rental year;
D is the CPI figure for Hobart for the quarter ending on 30 June 2007 (as amended by the Australian Bureau of Statistics from time to time).
