Valuation of Land (Tender Committee) Regulations 2022

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Valuation of Land Act 2001 .

1.   Short title

These regulations may be cited as the Valuation of Land (Tender Committee) Regulations 2022 .

2.   Commencement

These regulations take effect on 5 September 2022.

3.   Interpretation

In these regulations –
Act means the Valuation of Land Act 2001 ;
chairperson means the chairperson of the Committee;
member means a member of the Committee.

4.   Convening of meetings

A meeting of the Committee may be convened by the chairperson or by any 2 other members.

5.   Procedure at meetings

(1)  Three members form a quorum at any duly convened meeting of the Committee.
(2)  A duly convened meeting of the Committee at which a quorum is present is competent to transact any business of the Committee.
(3)  Questions arising at a meeting of the Committee are to be determined by a majority of votes of the members present and voting.
(4)  In the event of an equality of votes at a meeting of the Committee, the chairperson or other member presiding has a casting vote as well as a deliberative vote.

6.   Chairperson to preside

(1)  The chairperson is to preside at all meetings of the Committee at which they are present.
(2)  If the chairperson is not present at a meeting of the Committee, a member elected by the members present is to preside at the meeting.

7.   Minutes

The Committee must keep full and accurate minutes of proceedings at its meetings.

8.   Disclosure of interest

(1)  A member who has a direct or indirect pecuniary interest in a matter being considered by the Committee must, as soon as practicable after the relevant facts come to the knowledge of the member, disclose the nature of that interest at a meeting of the Committee.
(2)  A disclosure under subregulation (1) is to be recorded in the minutes and the member must not, unless the Committee determines otherwise –
(a) be present during any deliberations of the Committee in respect of the matter; or
(b) take part in any decision of the Committee in respect of that matter.

9.   General procedure

(1)  Subject to these regulations, the procedure for meetings of the Committee and the conduct of its business are to be as determined by the Committee.
(2)  The Committee may permit members to participate in any meeting by telephone, by video conference or by any other means which permits immediate communication.
(3)  A member who participates in a meeting by virtue of permission granted under subregulation (2) is taken to be present at the meeting.
(4)  The Committee may allow a person to attend a meeting for the purpose of advising or informing it on any matter.
