HomeBuilder Grants Regulations 2020

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the HomeBuilder Grants Act 2020 .

1.   Short title

These regulations may be cited as the HomeBuilder Grants Regulations 2020 .

2.   Commencement

These regulations are taken to have taken effect on 4 June 2020.

3.   Interpretation

In these regulations –
Act means the HomeBuilder Grants Act 2020 ;

[Regulation 3 Amended by No. 26 of 2022, s. 18, Applied:01 Dec 2022] Homes Tasmania means Homes Tasmania established by section 9(1) of the Homes Tasmania Act 2022 .

4.   Exclusion from application of section 21 of Act

If the Commissioner recognises a non-conforming interest as a relevant interest in land under section 7(4) of the Act, the holder of a relevant interest in the land (other than the holder of the non-conforming interest) is excluded from the application of section 21 of the Act.

5.   Exclusion of Homes Tasmania from application of section 21 of Act

[Regulation 5 Substituted by No. 26 of 2022, s. 19, Applied:01 Dec 2022] Homes Tasmania is excluded from the application of section 21 of the Act.

6.   Protection of confidential information

For section 52(4)(e) of the Act, protected information may be disclosed to a State Service officer or State Service employee employed in the Department if the information is not likely to identify a particular applicant for a Tasmanian HomeBuilder grant or a Commonwealth HomeBuilder grant.
