I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 60 of the Births, Deaths and Marriages Registration Act 1999 .

1.   Short title

These regulations may be cited as the Births, Deaths and Marriages Registration Regulations 2019 .

2.   Commencement

These regulations take effect on 5 September 2019.

3.   Interpretation

In these regulations –
Act means the Births, Deaths and Marriages Registration Act 1999 .

4.   Prescribed persons

For the purposes of section 46(3)(c) and (10) of the Act, the following persons are prescribed:
(a) the spouse, or a former spouse, of the person to whom the birth certificate relates (the registered person);
(b) a person who is, or has been, in a significant relationship, within the meaning of the Relationships Act 2003 , with the registered person;
(c) a parent of the registered person;
(d) an executor or administrator of the registered person’s estate;
(e) a person who holds a power of attorney in respect of the registered person;
(f) an agent of the registered person who has the written consent of the registered person;
(g) an officer or person acting on behalf of a court, or a law enforcement body, of the State, another State, a Territory or the Commonwealth.

5.   Fees

(1)  The fees set out in Schedule 1 are prescribed as the fees that are payable under the Act in respect of the matters to which they respectively relate.
(2)  The Registrar and a person who asks for a service that is not referred to in Schedule 1 may negotiate and fix the fee that is payable by the person for the service.

6.   Legislation rescinded

The legislation specified in Schedule 2 is rescinded.
