Proclamation under the Nature Conservation Act 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, by this my proclamation made under section 21(1) of the Nature Conservation Act 2002 declare that –

(a) the area of Crown land specified in Schedule 1 to this proclamation, being an area of reserved land known as a conservation area with the name River Derwent Conservation Area, ceases to be reserved land; and
(b) this proclamation takes effect on the day on which its making is notified in the Gazette.

Note The land at the River Derwent was declared a sanctuary for birds under the Animals and Birds Protection Act 1928 by a proclamation notified in the Gazette published on 28 February 1941. On the commencement of the National Parks and Wildlife Act 1970 the land became a conservation area under that Act. It continued to be a conservation area by virtue of Schedule 4 of the Nature Conservation Act 2002 .

SCHEDULE 1 - River Derwent Conservation Area revocation
All that area of land commencing at a point on Dogshear Point (also known as Triffit's Point) on the southern side of the River Derwent in the Parish of Glenorchy in the County of Buckingham and bounded by an imaginary line crossing that river in a due easterly direction to the foot of Mount Direction thence by the northern side of that river to the New Norfolk Bridge by that bridge again to the southern side of that river and thence by that side of the river to the point of commencement. Including the Tributaries Lachlan River and Sorell Creek and also the River Jordan from the mouth thereof to the place known as Cove Bridge on the road leading to Old Beach and also including all flats marshes and swamps adjacent to such rivers.
