Fisheries (Research Area) Order 1996

I make the following order under section 143 of the Living Marine Resources Management Act 1995 .

1.   Short title

This order may be cited as the Fisheries (Research Area) Order 1996 .

2.   Commencement

This order takes effect on 31 May 1996.

3.   Interpretation

(1)  In this order –
Act means the Living Marine Resources Management Act 1995 ;
George III Rock means the rock situated at latitude 43º30'36" south and longitude 146º58'58" east approximately 2 nautical miles north-east of Eliza Point;
George III Rock research area means the area specified in clause 4 .
(2)  An expression in this order that is defined in the Act has the same meaning as so defined.

4.   Research area

The part of State waters that is within an imaginary circle having a radius of 500 metres and centred at George III Rock is declared to be a research order.

5.   Restrictions in research area

A person, in the George III Rock research area, must not –
(a) take any fish by diving or swimming under water; or
(b) enter the waters of the area for the purpose of diving or swimming under water; or
(c) anchor a vessel.
