Fire Service (Extension of Regulations) Act 2017

An Act to provide for the retrospective postponement of the repeal of the Fire Service (Finance) Regulations 2006 and for related purposes

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Fire Service (Extension of Regulations) Act 2017 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Interpretation

In this Act, a reference to the Fire Service (Finance) Regulations 2006 is a reference to those regulations as in force immediately before 15 May 2016.

4.   Repeal of Fire Service (Finance) Regulations 2006 taken to have been postponed

(1)  Despite section 11(2) of the Subordinate Legislation Act 1992 , the repeal under that Act of the Fire Service (Finance) Regulations 2006 is taken not to have occurred on the tenth anniversary of the date on which notification of their making was published in the Gazette but instead at midnight on 18 April 2017.
(2)  Accordingly, for the avoidance of doubt –
(a) the Fire Service (Finance) Regulations 2006 are to be taken for all purposes as having been in full force and effect during the period commencing on 16 May 2006 and ending at midnight on 18 April 2017; and
(b) nothing in subsection (1) , or in section 11(2) of the Subordinate Legislation Act 1992 , is to be taken as limiting the operation of regulation 6 of the Fire Service (Finance) Regulations 2006 in its application to –
(i) the full term of the financial year commencing on 1 July 2015; and
(ii) the full term of the financial year commencing on 1 July 2016.

5.   Administration of Act

Until provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  –
(a) the administration of this Act is assigned to the Minister for Police, Fire and Emergency Management; and
(b) the department responsible to that Minister in relation to the administration of this Act is the Department of Police, Fire and Emergency Management.
