Commonwealth and State Statistical Agreement Act 1924

An Act to ratify and confirm an agreement entered into between the Commonwealth and the State with respect to the establishment by the Commonwealth of a statistical bureau in the State

Whereas the Commonwealth is about to establish in the State a statistical bureau:
And whereas the Commonwealth and the State have entered into an agreement with respect to certain matters relating to the establishment and operations of such statistical bureau, and the transfer of certain of the officers of the Statistical Department of the Public Service of the State to the Public Service of the Commonwealth:
And whereas it is desirable to ratify and confirm the said agreement, and to make provision for compensating certain of the officers to be so transferred, in respect of such transfer and of their liability to be retired from the Public Service of the Commonwealth at an earlier age than is provided by the law of the State in respect of the retirement of officers of the Public Service of the State:

Be it therefore enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Commonwealth and State Statistical Agreement Act 1924 .

2.   Interpretation

In this Act
the said agreement means the agreement entered into between the Commonwealth and the State, a copy whereof is set out in Schedule 1 .

3.   Agreement ratified

(1)  It shall be deemed to have been lawful for the State to have entered into the said agreement, and for the Premier to have executed the same on behalf of the State.
(2)  The said agreement is hereby ratified and confirmed.
(3)  It shall be lawful for the Premier to do or cause to be done all things necessary or convenient for the purpose of giving effect to the said agreement.

4.   Compensation payable to Lyndhurst Falkiner Giblin

In each and every year during the period of 13 years commencing on 1st January 1925, there shall be paid out of the Consolidated Revenue, without any further appropriation than this Act, to Lyndhurst Falkiner Giblin, the person holding the office of Government Statistician at the commencement of this Act, or to the executors, administrators, or assigns of the said Lyndhurst Falkiner Giblin, the sum of £55. Each such sum shall be paid by 12 equal monthly instalments of £4·11·8 each, the first of such instalments to be paid on 1st January in the year in which such sum is payable.

6.   Office of Government Statistician preserved

The office of Government Statistician shall continue to exist, and that officer shall, subject to the terms of the said agreement, continue to exercise the powers and perform the duties of his office.
