Public Health (Smoking Product Licence) Amendment Regulations (No. 2) 2026
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Public Health Act 1997 .

These regulations may be cited as the Public Health (Smoking Product Licence) Amendment Regulations (No. 2) 2026 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Public Health (Smoking Product Licence) Regulations 2019 are referred to as the Principal Regulations.
4. Regulation 1 amended (Short title)
Regulation 1 of the Principal Regulations is amended by omitting "(Smoking Product Licence)" and substituting "(Tobacco and Other Smoking Products)".
5. Regulation 6 inserted
After regulation 5 of the Principal Regulations , the following regulation is inserted:(1) The Secretary is to ensure that a record is kept, in respect of each financial year, of the number of –(a) short-term premises closure orders made under section 74LG(1) of the Act; and(b) complaints or other notifications of suspected non-compliance with Part 4 of the Act received by the Secretary, the Director or the Department; and(c) infringement notices served by authorised officers in relation to offences under Part 4 of the Act; and(d) other compliance and enforcement actions taken by or on behalf of the Secretary, the Director or the Department in relation to a provision of Part 4 of the Act.(2) The record is to be –(a) published on a website maintained by or on behalf of the Department; and(b) tabled in both Houses of Parliament as soon as practicable after the end of the financial year.(3) In this regulation –financial year means the 12-month period ending on 30 June in any year.

These regulations –(a) amend the Public Health (Smoking Product Licence) Regulations 2019 to prescribe reporting requirements in relation to compliance with and enforcement of Part 4 of the Public Health Act 1997 ; and(b) rename those regulations the Public Health (Tobacco and Other Smoking Products) Regulations 2019.
