Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Amendment Order 2026

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council and on the recommendation of the Minister, make the following order under section 19(3) of the Major Infrastructure Development Approvals Act 1999 .

1.   Short title

This order may be cited as the Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Amendment Order 2026 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

In this order –
Act means the Major Infrastructure Development Approvals Act 1999 .

4.   Principal Order

In this order, the Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Order 2020 is referred to as the Principal Order.

5.    Clause 3 amended (Interpretation)

Clause 3(1) of the Principal Order is amended as follows:
(a) by omitting " clause 4 ." from the definition of project proponent and substituting "clause 4;";
(b) by inserting the following definition after the definition of project proponent :
substitute line works means –
(a) the relocation of overhead transmission line towers to an adjacent alignment within the corridor specified in clause 5(a) ; and
(b) the substitution of those overhead transmission line towers with overhead transmission line poles.

6.    Clause 5 amended (Major infrastructure project)

Clause 5 of the Principal Order is amended as follows:
(a) by omitting from paragraph (e)(ii) "road." and substituting "road;";
(b) by inserting the following paragraph after paragraph (e) :
(f) the construction and operation of substitute line works that are determined to be necessary by the project proponent as a consequence of engineering or associated investigations, whether that determination occurs before or after the submission of an application for a planning permit by the project proponent.

7.   Determination regarding alteration of order

The Minister has determined that this order will not alter the Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Order 2020 made by the Governor under section 7(2) of the Act to such an extent or to such effect that this order should be submitted to Parliament for its approval.

(This note is not part of the order)

This order amends the Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Order 2020 by allowing the substitution of certain alignments and construction methods in relation to overhead lines to be included in the uses and developments that comprise the North West Transmission Upgrades Project.
