Road Amendment (Helmets) Rules 2025
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following rules under the Traffic Act 1925 .

These rules may be cited as the Road Amendment (Helmets) Rules 2025 .
These rules take effect on the day on which their making is notified in the Gazette.
In these rules, the Road Rules 2019 are referred to as the Principal Rules.
4. Rule 244B substituted
Rule 244B of the Principal Rules is rescinded and the following rule is substituted:244B. Wearing of helmets by users of motorised scooters
(1) A person who is travelling on a motorised scooter on a road or road-related area must wear an approved bicycle helmet securely fitted and fastened on his or her head, unless he or she is exempt from wearing a bicycle helmet under another law of this jurisdiction.Penalty: Fine not exceeding 2 penalty units.(2) A person is exempt from wearing a bicycle helmet under subrule (1) if (a) the person is a member of a religious group; and(b) the person is wearing a type of headdress that is customarily worn by members of the religious group; and(c) the wearing of the headdress makes it impracticable for the person to also wear a bicycle helmet.
5. Rule 244L substituted
Rule 244L of the Principal Rules is rescinded and the following rule is substituted:244L. Wearing of helmets by PMD users
(1) A PMD user must wear an approved bicycle helmet securely fitted and fastened on the PMD users head, unless the PMD user is exempt from wearing a bicycle helmet under another law of this jurisdiction.Penalty: Fine not exceeding 2 penalty units.(2) A PMD user is exempt from wearing a bicycle helmet under subrule (1) if (a) the PMD user is a member of a religious group; and(b) the PMD user is wearing a type of headdress that is customarily worn by members of the religious group; and(c) the wearing of the headdress makes it impracticable for the PMD user to also wear a bicycle helmet.
6. Rule 256 amended (Bicycle helmets)
Rule 256 of the Principal Rules is amended by inserting after subrule (2) the following subrule:(2A) A person is exempt from wearing an approved bicycle helmet under subrule (1) or (2) if (a) the person is a member of a religious group; and(b) the person is wearing a type of headdress that is customarily worn by members of the religious group; and(c) the wearing of the headdress makes it impracticable for the person to also wear a bicycle helmet.
7. Rule 257 amended (Riding with a person on a bicycle trailer)
Rule 257 of the Principal Rules is amended by inserting after subrule (1) the following subrule:(1A) A person is exempt from the requirement to wear an approved bicycle helmet under subrule (1) if (a) the person is a member of a religious group; and(b) the person is wearing a type of headdress that is customarily worn by members of the religious group; and(c) the wearing of the headdress makes it impracticable for the person to also wear an approved bicycle helmet.

These rules amend the Road Rules by providing an exemption for members of religious groups from the requirement to wear an approved bicycle helmet in certain circumstances.
