Firearms Amendment Regulations 2025

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Firearms Act 1996 .

1.   Short title

These regulations may be cited as the Firearms Amendment Regulations 2025 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Firearms Regulations 2016 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting the following definition after the definition of captive bolt device :
foam blaster means a toy firearm, including a device known as a NERF gun, or another device that is not an imitation firearm, that –
(a) is designed to propel a foam projectile by means of a spring, lever, compressed air or compressed gas; and
(b) is not a modified foam blaster;
(b) by omitting the definition of gel blaster and substituting the following definition:
gel blaster means a toy firearm or another device that is not an imitation firearm, that –
(c) is designed to propel hydrated polymer balls or other similar gel-like projectiles by means of compressed air or compressed gas; and
(d) is not a modified gel blaster;
(c) by omitting the definition of modified toy firearm and substituting the following definition:
modified, in relation to a foam blaster, gel blaster or toy firearm, means the blaster or toy firearm has been modified so as to be capable of propelling a projectile in a manner that could cause bodily harm to a person;
(d) by omitting the definition of toy foam blaster .

5.    Regulation 4 amended (Prescribed firearms)

Regulation 4 of the Principal Regulations is amended by omitting paragraphs (c) and (d) and substituting the following paragraph:
(c) a modified foam blaster, gel blaster or toy firearm.

6.    Regulation 5 amended (Devices prescribed not to be firearms)

Regulation 5 of the Principal Regulations is amended as follows:
(a) by inserting the following paragraphs after paragraph (a) :
(ab) a foam blaster;
(ac) a gel blaster;
(b) by omitting paragraph (e) .

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Firearms Regulations 2016 to declare foam blasters and gel blasters not to be firearms unless the blasters –
(a) are imitation firearms; or
(b) have been modified so as to be capable of propelling a projectile in a manner that could cause bodily harm to a person.
