Poisons Amendment (Authorised Health Professionals) Regulations 2025
I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment (Authorised Health Professionals) Regulations 2025 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poisons Regulations 2018 are referred to as the Principal Regulations.
4. Regulation 7 amended (Authorised health professionals)
Regulation 7 of the Principal Regulations is amended as follows:(a) by omitting from subregulation (1)(c) "(Tasmania)." and substituting "(Tasmania);";(b) by inserting the following paragraphs after paragraph (c) in subregulation (1) :(d) registered nurses whose registration is endorsed under section 94 of the Health Practitioner Regulation National Law (Tasmania);(e) pharmacists who are –(i) authorised to prescribe a scheduled substance under subregulation (4) ; or(ii) endorsed to prescribe a scheduled substance in accordance with section 25C(2) of the Act.(c) by omitting from subregulation (2)(b) "podiatrists." and substituting "podiatrists; and";(d) by inserting the following paragraphs after paragraph (b) in subregulation (2) :(c) the Nursing and Midwifery Board of Australia is prescribed as the authorised body for registered nurses; and(d) the Secretary of the Department is prescribed as the authorised body for pharmacists.(e) by inserting in subregulation (3) "registered nurse," after "optometrist,";(f) by inserting the following subregulations after subregulation (3) :(4) A pharmacist, in the lawful practice of the pharmacist’s profession, may possess, sell, supply or prescribe any scheduled substance in accordance with a protocol authorised by the Secretary, that specifically authorises the possession, sale, supply or prescription of that substance by a pharmacist.(5) Subject to these regulations, a pharmacist may only prescribe a scheduled substance –(a) in accordance with subregulation (4) ; or(b) if the pharmacist is endorsed to prescribe the substance in accordance with section 25C(2) of the Act.Penalty: Fine not exceeding 10 penalty units.

These regulations amend the Poisons Regulations 2018 by prescribing –(a) endorsed registered nurses and pharmacists as authorised health professionals for the purposes of the Poisons Act 1971 ; and(b) the circumstances in which endorsed registered nurses, and pharmacists, respectively, are authorised to prescribe scheduled substances.
