Rail Infrastructure (South and Derwent Valley Line Junction) Order 2025

I make the following order under sections 7 and 49 of the Rail Infrastructure Act 2007 .

1.   Short title

This order may be cited as the Rail Infrastructure (South and Derwent Valley Line Junction) Order 2025 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were regulations.

4.   Principal Act

In this order, the Rail Infrastructure Act 2007 is referred to as the Principal Act.

5.    Schedule 1 amended (The Rail Network)

Part 1 of Schedule 1 to the Principal Act is amended as follows:
(a) by omitting item 2 and substituting the following item:
2.   The Derwent Valley Line (being the railway running from the Bridgewater junction to the rail yard west of Maydena known as the Florentine Rail Yard, other than –
(a) the part of that railway at Bridgewater that is included in the area shown as Area 1 on Plan 11521 in the Central Plan Register; and
(b) the part of that railway that forms, under the Strategic Infrastructure Corridors (Strategic and Recreational Use) Act 2016 , the strategic infrastructure corridor, known as the Derwent Valley Corridor from Third Avenue to Back River Road, designated on Plan 11084 in the Central Plan Register.
(b) by omitting item 5 and substituting the following item:
5.   The South Line (being the railway running from McVilly Drive to Western Junction, other than –
(a) the part of that railway that forms, under the Strategic Infrastructure Corridors (Strategic and Recreational Use) Act 2016 , the strategic infrastructure corridor, known as the South Corridor from Elwick Road to Mentmore Street, designated on Plan 10597 in the Central Plan Register; and
(b) the part of that railway from the Bridgewater causeway on the south side of the River Derwent to Granton, as designated on Plan 11477 in the Central Plan Register; and
(c) the part of that railway at Bridgewater, including the part that crosses the Bridgewater Bridge and Bridgewater causeway and joins the part of the railway specified in paragraph (b) , that is included in the area designated as Area 1 on Plan 11521 in the Central Plan Register).

6.   Revocation of designation of ownership

In so far as it relates to the portions of railway included in the area designated as Area 1 in Plan 11521 in the Central Plan Register, the designation of Tasmanian Railway Pty Ltd (ACN 139 383 761) as Rail Infrastructure Owner is revoked.

EXPLANATORY NOTE

(This note is not part of the order)

This order –
(a) removes from the rail network under the Rail Infrastructure Act 2007 those portions of the South Line and Derwent Valley Line that are included in Area 1 designated in Plan 11521 in the Central Plan Register; and
(b) revokes the designation of Tasmanian Railway Pty Ltd as the Rail Infrastructure Owner in respect of that area.
