Taxi and Hire Vehicle Industries (Taxi Fares) Order 2025

The Transport Commission makes the following order under section 66A of the Taxi and Hire Vehicle Industries Act 2008 .

1.   Short title

This order may be cited as the Taxi and Hire Vehicle Industries (Taxi Fares) Order 2025 .

2.   Commencement

This order takes effect on 29 January 2025.

3.   Interpretation

(1)  In this order –
Act means the Taxi and Hire Vehicle Industries Act 2008 ;
flagfall means the amount charged on the taxi being set in motion at the beginning of the hiring;
regional taxi area means a taxi area that is not an urban taxi area, the King Island taxi area or the Flinders Island taxi area;
urban taxi area means the Hobart, Launceston, Burnie, Devonport, Perth, Ulverstone or West Tamar taxi areas;
(2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if as if this order were by-laws.

4.   Standard fares

The standard fares for the hire of a taxi are set out in the following Schedules:
(a) for the 12-month period commencing on 29 January 2025 – Schedule 1 ;
(b) for the 12-month period commencing on 29 January 2026 – Schedule 2 ;
(c) for the 12-month period commencing on 29 January in any subsequent year – Schedule 3 .

5.   Extra charges

(1)  The following surcharges may be charged:
(a) in the case of the hire of a taxi commencing between the hours of 10 p.m. Friday and 6 a.m. Saturday, or 10 p.m. Saturday and 6 a.m. Sunday, if those periods do not occur during the period specified in paragraph (b)  – $4.00;
(b) in the case of the hire of a taxi commencing between the hours of 10 p.m. on New Year’s Eve and 6 a.m. on New Year’s Day – $7.00.
(2)  In the case where credit arrangements have been made with the hirer, an accounting fee not exceeding 5% of the metered fare may be charged.
(3)  In the case where a taxi has been soiled or befouled by a passenger travelling in the taxi, the responsible operator of the taxi licence or a driver of the taxi may charge that passenger a fee of up to $100, being the amount that the responsible operator or driver estimates to be the reasonable costs of cleaning the taxi.
(4)  The responsible operator of a taxi licence or driver of a taxi may charge the hirer an extra charge for road tolls, ferry charges and entry or exit fees, incurred during the hire of the taxi, if the responsible operator or driver –
(a) is able to produce a receipt demonstrating payment of the toll, charge or fee; or
(b) has incurred, or will incur, a liability to pay the toll, charge or fee.

6.   Legislation revoked

The legislation specified in Schedule 4 is revoked.
SCHEDULE 1 - Standard fares 29 January 2025 to 28 January 2026

Clause 4(a)

1.   Interpretation
In this Schedule –
first tariff, in respect of a taxi that is not a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged between the hours of 6 a.m. and 8 p.m. on any weekday that is not a public holiday in the place where the taxi is hired;
fourth tariff, in respect of a taxi that is a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged in respect of the taxi at all times to which the third tariff does not apply;
second tariff, in respect of a taxi that is not a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged in respect of the taxi at all times to which the first tariff does not apply;
third tariff, in respect of a taxi that is a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged between the hours of 6 a.m. and 8 p.m. on any weekday that is not a public holiday in the place where the taxi is hired;
waiting time means time during which a taxi is –
(a) stationary; or
(b) moving at a speed of less than –
(i) in the case of an urban taxi area –
(a) when the taxi is operating under the first tariff, 18.1 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 15.1 kilometres per hour; and
(ii) in the case of the King Island taxi area or Flinders Island taxi area –
(a) when the taxi is operating under the first tariff, 17.4 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 14.5 kilometres per hour; and
(iii) in the case of a regional taxi area –
(a) when the taxi is operating under the first tariff, 18.1 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 15.1 kilometres per hour; and
(iv) in the case of any taxi area, where the taxi is a taxi referred to in clause 5(1)  –
(a) when the taxi is operating under the third tariff, 17.4 kilometres per hour; and
(b) when the taxi is operating under the fourth tariff, 14.5 kilometres per hour.
2.   Standard fares for taxi operating under a licence that relates to an urban taxi area
(1) This clause applies to a taxi that operates under a licence –
(a) that relates to an urban taxi area; or
(b) that has a condition imposed on the licence authorising the tariff for the taxi to be charged in accordance with this clause.
(2) The first tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –

(1) This clause applies to a taxi that operates under a licence –
(a) that relates to the King Island taxi area or the Flinders Island taxi area; or
(b) that has a condition imposed on the licence authorising the tariff for the taxi to be charged in accordance with this clause.
(2) The first tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –

(b) that has a condition imposed on the licence authorising the tariff for the taxi to be charged in accordance with this clause.
(2) The first tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –

5.   Standard fares for wheelchair-accessible taxis while conveying a wheelchair passenger in a taxi area
(1) This clause relates to –
(a) a wheelchair-accessible taxi; or
(b) a remote area wheelchair-accessible taxi; or
(c) a substitute wheelchair-accessible taxi; or
(d) a vehicle approved under section 93 of the Act to provide a service equivalent to a wheelchair-accessible taxi service –
that conveys a passenger travelling in a wheelchair in any taxi area.
(2) The third tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –

6.   High-occupancy vehicle tariff
The operator of a wheelchair-accessible taxi, remote area wheelchair-accessible taxi or substitute wheelchair-accessible taxi, when carrying 5 or more passengers, may charge a high-occupancy vehicle tariff equivalent to the fourth tariff set out in clause 5(3) .
SCHEDULE 2 - Standard fares, 29 January 2026 to 28 January 2027

Clause 4(b)

1.   Interpretation
In this Schedule –
first tariff, in respect of a taxi that is not a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged between the hours of 6 a.m. and 8 p.m. on any weekday that is not a public holiday in the place where the taxi is hired;
fourth tariff, in respect of a taxi that is a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged in respect of the taxi at all times to which the third tariff does not apply;
second tariff, in respect of a taxi that is not a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged in respect of the taxi at all times to which the first tariff does not apply;
third tariff, in respect of a taxi that is a taxi referred to in clause 5(1) of this Schedule, means the tariff to be charged between the hours of 6 a.m. and 8 p.m. on any weekday that is not a public holiday in the place where the taxi is hired;
waiting time means time during which a taxi is –
(a) stationary; or
(b) moving at a speed of less than –
(i) in the case of an urban taxi area –
(a) when the taxi is operating under the first tariff, 18.1 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 15.1 kilometres per hour; and
(ii) in the case of the King Island taxi area or Flinders Island taxi area –
(a) when the taxi is operating under the first tariff, 16.8 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 14 kilometres per hour; and
(iii) in the case of a regional taxi area –
(a) when the taxi is operating under the first tariff, 18.1 kilometres per hour; and
(b) when the taxi is operating under the second tariff, 15.1 kilometres per hour; and
(iv) in the case of any taxi area, where the taxi is a taxi referred to in clause 5(1)  –
(a) when the taxi is operating under the third tariff, 16.8 kilometres per hour; and
(b) when the taxi is operating under the fourth tariff, 14 kilometres per hour.
2.   Standard fares for taxi operating under a licence that relates to an urban taxi area
(1) This clause applies to a taxi that operates under a licence –
(a) that relates to an urban taxi area; or
(b) that has a condition imposed on the licence authorising the tariff for the taxi to be charged in accordance with this clause.
(2) The first tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –

Clause 4(c)

1.   Interpretation
In this Schedule –
first tariff means the tariff to be charged between the hours of 6 a.m. and 8 p.m. on any weekday that is not a public holiday in the place where a taxi is hired;
second tariff means the tariff to be charged in respect of a taxi at all times to which the first tariff does not apply;
waiting time means time during which a taxi is –
(a) stationary; or
(b) when the taxi is operating under the first tariff, moving at a speed of 16.2 kilometres per hour; or
(c) when the taxi is operating under the second tariff, moving at a speed of 13.5 kilometres per hour.
2.   Standard fares for taxis
(1) This clause relates to all taxis operating under a licence in accordance with the Act, in all taxi areas.
(2) The first tariff to be charged by a taxi to which this clause applies is the amount recorded on the taximeter when the taximeter is calibrated to record –
