Firearms Amendment Regulations 2024

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Firearms Act 1996.

1.   Short title

These regulations may be cited as the Firearms Amendment Regulations 2024 .

2.   Commencement

These regulations take effect on 1 December 2024.

3.   Principal Regulations

In these regulations, the Firearms Regulations 2016 are referred to as the Principal Regulations.

4.    Regulation 3 amended (Interpretation)

Regulation 3 of the Principal Regulations is amended as follows:
(a) by inserting the following definition after the definition of captive bolt device :
gel blaster means an air gun designed to fire or propel hydrated superabsorbent polymer balls or other similar gel-like projectiles by means of compressed air or compressed gas;
(b) by inserting the following definition after the definition of line thrower :
modified toy firearm means a toy firearm that has been modified from its original manufactured state to fire a projectile that has the potential to cause bodily harm to a person;
(c) by omitting the definition of phasor and substituting the following definitions:
phaser means a device that –
(a) is fitted with a transmitter or receiver of infrared electromagnetic waves; and
(b) cannot easily be modified to fire a projectile;
toy foam blaster means a toy firearm, including a device known as a NERF gun, that –
(a) uses springs, levers or compressed gas or compressed air to propel a foam bullet or dart; and
(b) has not been modified from its manufactured state.

5.    Regulation 4 amended (Prescribed firearms)

Regulation 4 of the Principal Regulations is amended as follows:
(a) by omitting from paragraph (b) "person." and substituting "person;";
(b) by inserting the following paragraphs after paragraph (b) :
(c) a gel blaster;
(d) a modified toy firearm.

6.    Regulation 5 amended (Devices prescribed not to be firearms)

Regulation 5 of the Principal Regulations is amended by omitting paragraph (e) and substituting the following paragraphs:
(e) a toy foam blaster;
(f) a phaser.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Firearms Regulations 2016 by –
(a) prescribing gel blasters and modified toy firearms as firearms; and
(b) declaring toy foam blasters not to be firearms.
