Poisons Amendment Regulations (No. 2) 2023
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

These regulations may be cited as the Poisons Amendment Regulations (No. 2) 2023 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Poisons Regulations 2018 are referred to as the Principal Regulations.
4. Regulation 51 amended (Dispensing prescriptions for restricted substances (S4))
Regulation 51 of the Principal Regulations is amended by omitting subregulation (18) and substituting the following subregulation:(18) A person must not dispense a prescription for a restricted substance or supply a restricted substance upon a prescription if the prescription is presented for dispensing more than 12 months after the date on which the prescription was written unless otherwise permitted under the Act or these regulations.Penalty: Fine not exceeding 10 penalty units.
5. Regulation 128 amended (Disability service workers may assist with self-administration)
Regulation 128 of the Principal Regulations is amended by inserting "of the department responsible for the administration of the Disability Services Act 2011 " after "Secretary".

These regulations amend the Poisons Regulations 2018 by (a) allowing for an extension of the period during which certain substances can be dispensed or supplied after the date of prescription; and(b) updating the reference to the Secretary with administrative responsibility for regulating disability services programs.
