Traffic (Compliance and Enforcement) Amendment (Offence Detection Devices) Regulations 2023
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Traffic Act 1925 .

These regulations may be cited as the Traffic (Compliance and Enforcement) Amendment (Offence Detection Devices) Regulations 2023 .
These regulations take effect on the day on which the Vehicle and Traffic Amendment (Driver Distraction and Speed Enforcement) Act 2022 commences.
In these regulations, the Traffic (Compliance and Enforcement) Regulations 2017 are referred to as the Principal Regulations.
4. Regulation 7 amended (Specified offences for section 54(1AA) of Act)
Regulation 7(b) of the Principal Regulations is amended by inserting "portable device offence, seatbelt offence, registration offence," after "light offence,".
5. Schedule 1 amended (Offences)
Division 2 of Part 1 of Schedule 1 to the Principal Regulations is amended as follows:(a) by inserting after item 363 in Subdivision 43 the following:

RR 264(1)
Driver fail to wear properly adjusted and fastened seatbelt (when vehicle moving/stationary, but not parked) (photographic detection device)

(b) by inserting after item 365 in Subdivision 43 the following:
365A.
RR 265(3) or 266(1)
Driver fail to ensure passenger is restrained as required (when vehicle moving/stationary, but not parked) (photographic detection device)

(c) by inserting after item 414A in Subdivision 45 the following:
414AB.
RR 300(1) or 300(1A)
Drive using mobile phone (when vehicle moving or stationary, but not parked) except as permitted (photographic detection device)
