Health Service Establishments Amendment Regulations 2023
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Health Service Establishments Act 2006 .

These regulations may be cited as the Health Service Establishments Amendment Regulations 2023 .
These regulations take effect on the day on which their making is notified in the Gazette.
In these regulations, the Health Service Establishments Regulations 2021 are referred to as the Principal Regulations.
4. Schedule 1 amended (General Licensing Standards for Private Hospitals and Day-procedure Centres)
Schedule 1 to the Principal Regulations is amended by omitting clause 1 from Part 1 and substituting:1. Building requirements(1) The requirements relating to Class 9a buildings specified in the National Construction Code, within the meaning of the Building Act 2016 , must be observed in relation to:(a) private hospitals; and(b) surgical class day procedure centres; and(c) endoscopic class day procedure centres.(2) Subject to subclause (3) , the requirements relating to Class 5 buildings specified in the National Construction Code, within the meaning of the Building Act 2016 , must be observed in relation to low-risk class day procedure centres.(3) Despite subclause (2) , the Secretary may determine, upon consideration of public safety and service quality, that a particular low-risk class day procedure centre must comply with the requirements relating to Class 9a buildings specified in the National Construction Code within the meaning of the Building Act 2016 .

These regulations amend the Health Service Establishments Regulations 2021 by specifying the class of building in which private hospitals and certain day-procedure centres may operate.
