Justices (Review) Amendment Rules 2021

We, the Honourable Alan Michael Blow, AO, Chief Justice, and the Honourable Helen Marie Wood, the Honourable Stephen Peter Estcourt, AM, the Honourable Robert William Pearce, the Honourable Michael Joseph Brett, the Honourable Gregory Peter Geason and the Honourable Tamara Kaye Jago, Puisne Judges of the Supreme Court of Tasmania, on the recommendation of the Rule Committee, make the following general rules under and for the purposes of Part XI of the Justices Act 1959 .

1.   Short title

These Rules of Court may be cited as the Justices (Review) Amendment Rules 2021 .

2.   Commencement

These Rules of Court take effect on the day on which their making is notified in the Gazette.

3.   Principal Rules

In these Rules of Court, the Justices (Review) Rules 2004 are referred to as the Principal Rules.

4.    Rule 6 amended (Notice to review)

Rule 6 of the Principal Rules is amended by omitting subrule (1) and substituting the following subrule:
(1)  A notice to review is to be made returnable on a Wednesday in a sittings to be held at the place nearest to the court from which the appeal is brought.

These Rules of Court amend the Justices (Review) Rules 2004 by updating the practice and procedure requirements as to when a notice to review is to be made returnable.
