Environmental Management and Pollution Control (Noise) Amendment Regulations 2021

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .

1.   Short title

These regulations may be cited as the Environmental Management and Pollution Control (Noise) Amendment Regulations 2021 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Environmental Management and Pollution Control (Noise) Regulations 2016 are referred to as the Principal Regulations.

4.    Regulation 8 amended (Motor vehicles and motor vessels operated near residential premises for purposes of sport or recreation)

Regulation 8 of the Principal Regulations is amended by inserting after subregulation (3) the following subregulation:
(4)  Subregulation (1) does not apply to a motor vessel being operated within a designated ski area, within the meaning of the Marine and Safety (Motor Boats and Licences) By-laws 2013.

These regulations amend the Environmental Management and Pollution Control (Noise) Regulations 2016 by exempting the operation of a motor vessel from certain requirements in respect of the operation of that vessel near residential premises.
