Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Order 2021

I make the following order under section 11(1)(f) of the Major Infrastructure Development Approvals Act 1999 .

1.   Short title

This order may be cited as the Major Infrastructure Development Approvals (North West Transmission Upgrades Project) Order 2021 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Interpretation

(1)  In this order –
Act means the Major Infrastructure Development Approvals Act 1999 ;
Commonwealth Department means the Commonwealth Department of Agriculture, Water and the Environment;
proponent’s environmental report means a report by the proponent that takes into account representations on any matters of national environmental significance resulting from the North West Transmission Upgrades project.
(2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws.

4.   Extension

For the purposes of section 11(1)(f) of the Act, a period of 30 days after the Commission receives notification from the Commonwealth Department that that Department is satisfied with the proponent’s environmental report is specified as the further period within which the Commission must grant or refuse to grant a permit for a use or development of the North West Transmission Upgrades project.

(This note is not part of the order)

This order provides for a further period within which the Tasmanian Planning Commission may grant or refuse to grant a permit for a use or development of the North West Transmission Upgrades Project.
