Poisons Amendment Regulations 2021

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .

1.   Short title

These regulations may be cited as the Poisons Amendment Regulations 2021 .

2.   Commencement

These regulations take effect on the day on which their making is notified in the Gazette.

3.   Principal Regulations

In these regulations, the Poisons Regulations 2018 are referred to as the Principal Regulations.

4.    Regulation 54A inserted

After regulation 54 of the Principal Regulations , the following regulation is inserted in Division 2:

54A.   Administration of certain vaccines

(1)  For the purposes of section 47A of the Act, a registered nurse, enrolled nurse, paramedic, midwife, pharmaceutical chemist or pharmacy trainee may administer, subject to the conditions specified in subregulation (2) , a vaccine that is a restricted substance.
(2)  A person specified in subregulation (1) may only administer, under this regulation, a vaccine that is a restricted substance if –
(a) the Director of Public Health has approved the administration of the vaccine under this regulation; and
(b) the person is –
(i) a registered nurse, enrolled nurse, paramedic, midwife, pharmaceutical chemist, or pharmacy trainee, who has been approved by the Director of Public Health to administer the vaccine under this regulation; or
(ii) a member of a class of registered nurses, enrolled nurses, paramedics, midwives, pharmaceutical chemists, or pharmacy trainees, that has been approved by the Director of Public Health to administer the vaccine under this regulation; and
(c) the vaccine is administered in accordance with a vaccination program approved by the Director of Public Health; and
(d) the vaccine is administered under the supervision of –
(i) if the person administering the vaccine is a registered nurse, enrolled nurse, paramedic, midwife, pharmaceutical chemist or pharmacy trainee, a person who –
(A) is a registered nurse or midwife; and
(B) satisfies the requirements of regulation 82(1)(c) ; or
(ii) if the person administering the vaccine is a pharmaceutical chemist or a pharmacy trainee, a pharmaceutical chemist who satisfies the requirements of regulation 82(1)(d) .

5.    Regulation 82 amended (Prescribed persons for section 38(1)(i) of Act)

Regulation 82 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1)(e) "registered nurse, midwife, pharmaceutical chemist or pharmaceutical chemist who holds provisional registration with AHRPA" and substituting "registered nurse, enrolled nurse, paramedic, midwife, pharmaceutical chemist or pharmacy trainee";
(b) by omitting subparagraph (ii) from subregulation (1)(e) and substituting the following subparagraph:
(ii) is authorised to administer the vaccine under regulation 54A ; and
(c) by omitting from subregulation (1)(f) "pharmaceutical chemist who holds provisional registration with AHPRA" and substituting "pharmacy trainee";
(d) by omitting subparagraph (ii) from subregulation (1)(f) and substituting the following subparagraph:
(ii) is authorised to administer the vaccine under regulation 54A ; and
(e) by omitting subregulation (2) .

These regulations amend the Poisons Regulations 2018 by providing for the administration, in specified circumstances, of certain vaccines that are restricted substances.
