HomeBuilder Grants (Amendment of Act) Order 2021

I make the following order under section 19(1) of the HomeBuilder Grants Act 2020 .

1.   Short title

This order may be cited as the HomeBuilder Grants (Amendment of Act) Order 2021 .

2.   Commencement

This order is taken to have taken effect on 4 June 2020.

3.   Principal Act

In this order, the HomeBuilder Grants Act 2020 is referred to as the Principal Act.

4.    Section 13 amended (Eligible transaction for Tasmanian HomeBuilder grant)

Section 13(1)(d) of the Principal Act is amended by omitting "6 months" and substituting "18 months".

5.    Section 18 amended (Eligible transaction for Commonwealth HomeBuilder grant)

Section 18(1)(c) of the Principal Act is amended by omitting "6 months" and substituting "18 months".

6.    Section 20 amended (Application for grant)

Section 20 of the Principal Act is amended by inserting after subsection (3) the following subsection:
(3A)  If the Commissioner requires further information under subsection (3)  –
(a) the Commissioner may refuse to determine the application until the further information is provided as required; and
(b) the application is taken to lapse if the further information is not provided before 1 May 2023.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the HomeBuilder Grants Act 2020 , to ensure that that Act is consistent with the National Partnership, by –
(a) increasing the period during which building must commence under certain eligible contracts; and
(b) specifying that an application under the Act lapses if further information in support of the application is requested but not provided by a specified date.
