Luxury Hire Car Industry Amendment Regulations 2020
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Taxi and Hire Vehicle Industries Act 2008 .

These regulations may be cited as the Luxury Hire Car Industry Amendment Regulations 2020 .
These regulations take effect on 30 December 2020.
In these regulations, the Luxury Hire Car Industry Regulations 2018 are referred to as the Principal Regulations.
4. Regulation 8 amended (Prescribed criteria for approval of luxury hire car)
Regulation 8 of the Principal Regulations is amended by inserting after subregulation (2) the following subregulations:(3) A person must not operate a vehicle as a luxury hire car if the vehicle does not have an Australasian New Car Assessment Program (ANCAP) rating of 5 stars.Penalty: Fine not exceeding 20 penalty units.(4) Subregulation (3) does not apply in respect of a vehicle that, on 30 December 2020, was being, or had previously been, operated as a luxury hire car.
5. Regulation 9 substituted
Regulation 9 of the Principal Regulations is rescinded and the following regulation is substituted:9. Maximum age for luxury hire car
(1) A person must not operate a vehicle as a luxury hire car if the age of the vehicle exceeds the following:(a) in the case of a Group A vehicle, 12 years;(b) in the case of a Group B vehicle, 12 years;(c) in the case of a Group C vehicle, 15 years;(d) in the case of a Group D vehicle, 20 years.Penalty: Fine not exceeding 20 penalty units.(2) A person must not operate a vehicle as a luxury hire car for the first time if the age of the vehicle exceeds 7 years.Penalty: Fine not exceeding 20 penalty units.(3) On and after 30 December 2020, a person must not operate a vehicle as a luxury hire car if the age of the vehicle exceeds 12 years unless the vehicle, at that date, was being, or had previously been, operated as a luxury hire car.Penalty: Fine not exceeding 20 penalty units.

(This note is not part of the regulation)
These regulations amend the Luxury Hire Car Industry Regulations 2018 by (a) requiring that a vehicle must not be operated as a luxury hire car for the first time unless it has an ANCAP rating of 5 stars and is not more than 7 years old; and(b) specifying maximum age requirements for luxury hire cars.
