Inland Fisheries (Seasons and Waters) Amendment Order 2020

I make the following order under section 197 of the Inland Fisheries Act 1995 .

1.   Short title

This order may be cited as the Inland Fisheries (Seasons and Waters) Amendment Order 2020 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Order

In this order, the Inland Fisheries (Seasons and Waters) Order 1996 is referred to as the Principal Order.

4.    Clause 3 amended (Interpretation)

Clause 3(1) of the Principal Order is amended as follows:
(a) by omitting " Inland Fisheries (Recreational Fishing) Regulations 2009 " from the definition of Canal Bay and substituting " Inland Fisheries Regulations 2019 ";
(b) by omitting " Inland Fisheries (Recreational Fishing) Regulations 2009 ." from the definition of junior angling development fishery and substituting " Inland Fisheries Regulations 2019 ;";
(c) by inserting the following definition after the definition of junior angling development fishery :
Upper Mersey Lakes Rainbow Fishery means the waters of –
(a) Lake Meston, Junction Lake and Lake Youd; and
(b) such part of the Mersey River that flows within and between the Western Lakes, including the tributaries that flow off that river in that area.

5.    Clause 4 amended (Taking of acclimatised fish)

Clause 4 of the Principal Order is amended as follows:
(a) by omitting subparagraphs (viii) and (ix) from subclause (1)(b) and substituting the following subparagraphs:
(viii) Weld River (in the north of the State at Harridge Falls) from an imaginary straight line drawn between the opposite shores of the river located approximately at grid reference 575751E 5443429N and grid reference 575760E 5443419N upstream to its source; and
(ix) Weld River (in the south of the State at the confluence of the Huon River) from an imaginary straight line drawn between the opposite shores of the river located approximately at grid reference 481068E 5232960N and grid reference 481033E 5232964N upstream to its source;
(b) by inserting the following paragraph after paragraph (b) in subclause (2) :
(c) at Camden Dam (being the body of water located at grid reference 539933E 5424268N) from one hour before sunrise to three hours after sunset; and

6.    Clause 5 amended (Taking indigenous fish)

Clause 5 of the Principal Order is amended as follows:
(a) by omitting from paragraph (a) "to the Inland Fisheries (Recreational Fishing) Regulations 2009 " and substituting "of the Inland Fisheries Regulations 2019 ";
(b) by omitting from paragraph (d) " Inland Fisheries (Recreational Fishing) Regulations 2009 " and substituting " Inland Fisheries Regulations 2019 ".

7.    Schedule 1 substituted

Schedule 1 to the Principal Order is revoked and the following Schedule is substituted:

8.   Revocation of order

This order is revoked on the first anniversary of the day on which it took effect.

This order is administered in the Department of Primary Industries, Parks, Water and Environment.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Inland Fisheries (Seasons and Waters) Order 1996 by –
(a) defining the Upper Mersey Lakes Rainbow Fishery; and
(b) enabling acclimatised fish to be taken from Camden Dam in certain circumstances; and
(c) clarifying the years in which whitebait may be taken from certain rivers; and
(d) clarifying the parts of the Weld River from which acclimatised fish may be taken; and
(e) effecting minor statute law revision.
