Administrative Arrangements (Removal of Inconsistency) Order 2020

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 5(2) of the Administrative Arrangements Act 1990 .

1.   Short title

This order may be cited as the Administrative Arrangements (Removal of Inconsistency) Order 2020 .

2.   Commencement

This order takes effect on the day on which its making is notified in the Gazette.

3.   Principal Act

In this order, the Mental Health Act 2013 is referred to as the Principal Act.

4.    Section 3 amended (Interpretation)

Section 3(1) of the Principal Act is amended as follows:
(a) by omitting the definition of Minister for Health ;
(b) by inserting the following definition after the definition of responsibility :
responsible Minister means the Minister to whom the administration of this Act, except Parts 2 and 3 of Chapter 3, and Schedules 3, 4 and 5, is assigned;

5.    Section 156 amended (Functions of Principal Official Visitor)

Section 156(1)(h) of the Principal Act is amended by omitting "Minister for Health" and substituting "responsible Minister".

6.    Section 160 amended (Visits)

Section 160(2)(d) of the Principal Act is amended by omitting "Minister for Health" and substituting "responsible Minister".

7.    Section 165 amended (Operational and monthly reporting, &c.)

Section 165 of the Principal Act is amended as follows:
(a) by omitting from subsection (2) "Minister for Health" and substituting "responsible Minister";
(b) by omitting from subsection (3)(a) "Minister for Health" and substituting "responsible Minister";
(c) by omitting from subsection (3)(b) "Minister for Health" and substituting "responsible Minister".

8.    Section 166 amended (Annual report)

Section 166 of the Principal Act is amended as follows:
(a) by omitting from subsection (1) "Minister for Health" and substituting "responsible Minister";
(b) by omitting from subsection (2) "Minister for Health" and substituting "responsible Minister";
(c) by omitting from subsection (3) "Minister for Health" and substituting "responsible Minister".

This order is administered in the Department of Premier and Cabinet.

EXPLANATORY NOTE

(This note is not part of the order)

This order amends the Mental Health Act 2013 so as to replace certain references that are inconsistent with the administrative arrangements made under the Administrative Arrangements Act 1990 .
